FREQUENTLY ASKED QUESTIONS IN SECURING MINOR’S TRAVEL CLEARANCE CERTIFICATE
To prevent child trafficking, Republic Act 7610 (otherwise known as Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act) requires unaccompanied minors below 18 years old who are traveling abroad to secure a travel clearance from the Department of Social Welfare and Development or written permit or justification from the child’s parents or legal guardians (Article IV, Section 8a).
A Travel Clearance is a document issued by the DSWD to a minor traveling outside the Philippines, alone or unaccompanied by his/her parents or accompanied by a person other than his/her parents certifying that the minor is authorized to travel abroad for valid reasons.
Who are required to secure a travel clearance?

Children below 18 years old traveling abroad and who are in any of the following circumstances:

Traveling alone;
-
Traveling with a person other than his/her parents or those exercising parental and legal custody of the child;

Traveling for the purpose of adoption abroad (inter-country adoption);
-
Minor adopted in the Philippines;

An illegitimate child traveling with his/her father; and
-
A minor traveling with a group for sports competition, cultural presentation, pilgrimage, scholarship purposes or study tours.
Who are NOT required to secure a travel clearance?

A minor whose parents are in the foreign service or are living abroad or are immigrants provided he/she is holding a valid pass such as a dependent’s visa/pass/identification card or permanent resident visa/pass/identification card which serve as proof that he/she is living with parents abroad.

A minor traveling with either or both parent/s.
Who can file for travel clearance?

A minor who is 13 years old and above;

The minor’s parents or legal guardian/s;

The minor’s traveling companion; and
-
Authorized representative of the minor’s parents/legal guardian.
What are the requirements for securing a travel clearance?
For a minor traveling abroad alone/unaccompanied:

Photocopy of the birth certificate or passport of the minor
-
Photocopy of marriage certificate of minor’s parents,
OR photocopy of certificate of legal guardianship of the minor
OR in the case of solo parents, photocopy of the solo parent ID from the MSWDO
OR certification from the local MSWDO of being a solo parent
OR a court decree of separation, annulment or divorce
OR Tallaq or Fasakh certification from the Shariah court or any Muslim barangays or religious leader
OR in the case of an illegitimate minor, a certificate of no marriage from local civil registrar
OR in case of a deceased parent, photocopy of the death certificate.

Written consent of parents/guardian for a child to travel alone, or authorizing a particular person to accompany child in his/her travel abroad

Two colored passport - size pictures of minor taken within the last six (6) months.
For a minor traveling abroad with a person other than the parent/s:

What are the procedures in the issuance of a travel clearance?

Application: The application for travel clearance together with the supporting documents required shall be submitted/filed by the parent or legal guardian or a duly authorized representative at any DSWD Field (regional) Office. Application forms may be obtained from any DSWD Field Office or Travel Clearance Unit.

Issuance: The travel clearance may be obtained within three (3) working days from the DSWD Field Office or Travel Clearance Unit where it was submitted, provided all requirements have been fulfilled.

Fees: The DSWD shall collect a processing fee of P300.00 for each travel clearance issued to minors traveling abroad in accordance to Administrative Order No. 60, series of 2003 (Amendment in the Guidelines on the Charging of Fees and Services). An official receipt shall be issued for the fee collected.

Validity: A travel clearance certificate shall be valid for a period of one (1) year from the date of issuance and shall be valid for multiple travels within the validity period, provided that the conditions under which the travel clearance was issued have not changed. If a change in condition occurs, e.g. a change in traveling companion, a new travel clearance must be obtained.

Coverage: A travel clearance shall cover only one child, siblings shall be issued separate clearances.
What is the specific age of a minor allowed to travel alone/unaccompanied?
A minor regardless of age can travel abroad alone/unaccompanied as long as the parent/s issued a consent.
Who would give consent for the travel of a totally orphaned minor who has no appointed legal guardian?

The paternal/maternal grandparents who exercise parental authority over a minor whose parents are both deceased may issue the consent even without guardianship order from the court.

In cases where both paternal/maternal grandparents are deceased, relatives/acting guardian of the minor should work out for their legal guardianship over the minor.
What about those children whose parents have marital conflict and are on hold order?
The court should issue the authority to travel to a minor with either parent.
Is a travel clearance being issued to illegitimate children?

Illegitimate children are under the custody of the mother. If they will be traveling with the mother, they are no longer required and will not be issued a travel clearance.

But if the illegitimate children will be traveling with a person other than the mother, they will be issued a travel clearance.
Children accompanied by one parent secure travel clearance because of being denied at the Bureau of Immigration/airlines and for paying surcharges/penalties and delayed flights.
The Department of Foreign Affairs (Central Office) and Bureau of Immigration (Central Office and NAIA Terminal II) were already provided with copies of the Administrative Order No. 2, Series of 2006, also known as the Amended Omnibus Guidelines for Minors Traveling Abroad.
Is fax copy of the parental consent of parents residing abroad allowed/considered?
Faxed or electronic copy of parental consent is considered.
What is the policy for those going abroad for schooling or scholarship purposes?
The minor should secure a travel clearance from DSWD by submitting the required documents.
What are the requirements for illegitimate children abandoned by the mother and under the custody of the father or paternal relatives who will be traveling alone or with the father?

Since the mother has the absolute parental authority over her children, the father would need to secure a Court Order vesting in him the parental authority over the illegitimate children.

Once the parental authority is granted to the father, if the minor will be traveling with the father, they are no longer required to secure a travel clearance but if the minor will travel alone, he/she is required to secure a travel clearance for unaccompanied minor.
Does the parental consent need to be notarized or authenticated?
The parental consent need not be notarized or authenticated. A written consent of the parent/s is accepted/considered.
Are computer generated photographs of minor allowed?
In securing a travel clearance from DSWD, only original photographs of the minor and not computer generated photographs are accepted.
